POSITION SUMMARY

The Clerk’s Office for the United States District Court for the District of South Dakota is seeking qualified applicants for a full-time Deputy Clerk I in the Pierre, Rapid City and/or Sioux Falls, South Dakota offices. The Deputy Clerk I position maintains the court record through use of the Court's electronic case management system (CM/ECF) through the entirety of criminal and civil cases. The position performs a variety of clerical work including work with cashiering, customer service, jury operations support and courtroom support. These positions report to the Clerk's Office management team.

 

REPRESENTATIVE DUTIES

• Perform complex case management transactions such as opening and closing cases while ensuring the appropriate statistical data.

• Prepare and process appeals, warrants, subpoenas, notices and form orders.

• Answer inquiries from attorneys and the public regarding case status and procedural rules.

• Act as a courtroom deputy for civil and criminal proceedings. Assist with the orderly flow of proceedings including, but not limited to, setting up the courtroom, assuring the presence of all necessary participants, and operating all courtroom technology equipment. Take notes of proceedings and rulings and prepare and docket minute entries.

• Communicate with outside agencies, counsel, and the public to facilitate orderly case management and case progression.

• Coordinate the presence of court reporters and court interpreters when needed.

• Serve as back up for magistrate scheduling, coordinating with various government agencies.

• Process attorney admission applications, prepare certificates, attend admission ceremonies, and maintain record of admitted attorneys.

• Assist with jury administration by preparing juror summonses and assisting with jury selection/empanelment.

• Organize and arrange naturalization ceremonies. Representative duties include preparing programs and press releases, attending ceremonies, etc.

• Perform records management duties including requesting, maintaining, and returning records to the Federal Records Center, and filing and archiving documents using electronic imaging; etc.

• Perform cashier functions as outlined in the Internal Control Manual.

 

MINIMUM QUALIFICATIONS AND EXPERIENCE

To qualify for this position, a person must be a high school graduate, or equivalent, and have a minimum of one year of specialized experience.


Specialized Experience: Progressively responsible clerical or administrative experience requiring the regular and recurring application of clerical procedures that demonstrate the ability to apply a body of rules, regulations, directives, or laws and involve the routine use of specialized terminology and automated software and equipment for word processing, data entry or report generation. Such experience is commonly encountered in law firms, legal counsel offices, banking and credit firms, educational institutions, social service organizations, insurance companies, real estate firms, title companies, and corporate headquarters or human resources/payroll operations. Excellent customer service and problem-solving skills, and a high level of technical/computer aptitude is required for this position. Experience and knowledge of electronic case management systems and a good knowledge of the federal and local rules is required.

 

PREFERRED SKILLS

A bachelor’s degree is preferred. Current or previous experience as a courtroom deputy is highly desired. Familiarity with statistical reports processes is also highly desired.

The Contractor shall provide specialized legal research, writing, investigation, data analysis, discovery production and processing, and support for Affirmative Civil Enforcement (ACE) matters, including civil fraud and financial litigation matters. The USAO is soliciting GSA Scheduled contractors for one Paralegal or equally qualified candidates in the ACE Unit of its branch office located in Pierre, South Dakota. The Contractor is responsible for directly providing a wide variety of technical assistant services and independently supporting the ACE Assistant United States Attorneys (AUSA) within the Civil Division. The work requires a specialized knowledge of the processes, procedures, and practices of Paralegal activities in conjunction with knowledge of the federal and local rules of civil procedure, investigative techniques, medical billing and coding, financial frauds, healthcare fraud, clerical and administrative office skills and an ability to apply these skills to increase the effectiveness of the AUSAs. The Contractor will use a variety of automated legal research tools as well as public information databases, internal federal databases, and other automated resources to research case-specific or program-specific legal matters. Work will include analysis and processing of data, statistical information, evidence, statutes, legislative intent, judicial precedents, agency rules and regulations, and law review articles as they relate to assigned cases.

 

Task/Requirements: The Contractor shall provide services to include the following:

 

Provides a variety of direct legal support assistance services to serviced AUSA and Auditor staff. Typical assignments include:


•  Reviews and evaluates case referrals to determine the need for additional information and 

    evidence, and planning a comprehensive approach to obtain this information and evidence.

•  Advises the ACE attorney(s) regarding the merits and weaknesses of ACE referrals based 

    upon applicable law, evidence of liability and damages, and potential defenses.

•  Helps the ACE Unit develop new referrals by ensuring a good working relationship with 

    client agencies and the public.

•  Receives and analyzes incoming pleadings and correspondence. Determines appropriate 

    action and notes time limitations for responses.

•  Prepares initial drafts correspondence and legal documents for ACE attorney signature.

•  Prepares initial drafts of proposed orders and decrees for signatures of judges.

•  Researches legal and factual issues. Analyzes and summarizes the same.

•  Use automated resources, available databases, and technology for the development, 

    presentation, and prosecution of federal cases.

•  Use legal research tool and litigative support technology such as digital imaging 

    applications, graphic design software, audio-visual equipment, and trial presentation 

    programs.

•  Examines, prepares and processes a variety of technical legal documents and statistical 

    information that are characteristically voluminous and complex in format. Reviews 

    incoming material and independently determines the need for assembly and preparation of 

    a variety of legal documents, e.g., complaints, motions, orders, answers, pleadings, Civil 

    Investigative Demands and subpoenas. Obtains needed information from files, 

    administrative and law enforcement agencies, or other sources, and submits completed 

    legal documents to the appropriate AUSA. In preparation of documents, considers the 

    nature and the status of the case involved. With limited instructions from the AUSA, 

    prepares initial drafts of such legal actions as seal extensions, motions and other 

    pleadings. Completes variable aspects of preparing recurring legal documents that conform 

    to the rules governing their style and format.
